Arbitron And WKYC-TV Settle Suit

Arbitron says it has settled with Cleveland Television station WKYC, putting an end to legal action for copyright infringement, trademark infringement, and false designation of origin under the Lanham Act. A payment was made to Arbitron which was not revealed in the press release Arbitron put out announcing the settlement. The station agreed not to engage in any activities that would infringe Arbitronís intellectual property rights and Arbitron agreed not to pursue legal action.

Arbitron filed a lawsuit in January alleging WKYC copied and distributed Arbitronís copyrighted audience estimates without Arbitronís permission, and that WKYC-TV improperly used Arbitronís federally registered trademarks to create the false impression that non-Arbitron audience estimates for Internet radio service Pandora were genuine Arbitron products.
