LPFM Draws Fine For Late Renewal
WASHINGTON -- June 24, 2009: The FCC has issued a $500 forfeiture order to Soul's Harbor Assembly of God Church for late license renewal and unauthorized operation at low-power FM WRDS in Roscommon, MI.
The FCC in 2007 issued a $7,000 notice of apparent liability to the church, saying it had filed its 2004 license renewal application nearly a month after the LPFM's license had expired, and that it didn't apply for a special temporary authorization to stay on the air while the application was considered.
Soul's Harbor responded by asking that the fine be reduced or canceled, saying its failure to file was inadvertent and that it couldn't afford to pay. The FCC said accidental violations are still willful and didn't accept the church's unaudited financial statements, but it did follow its own recent precedent for LPFMs and reduced the fine to $500.
